Terms and Conditions

Article 1. Definitions
1.1. Kootje Boef, located in Heiloo, The Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 78052173, hereinafter referred to as “Kootje Boef”.
1.2. Website: www.kootjeboef.com and all associated pages and subdomains.
1.3. Customer: any natural person or legal entity entering into an agreement with Kootje Boef.
1.4. Agreement: any order, purchase, or arrangement between Kootje Boef and the Customer.
1.5. Terms and Conditions: these Terms and Conditions.
Article 2. Applicability
2.1. These Terms and Conditions apply to all offers, orders, agreements, and deliveries made by Kootje Boef.
2.2. Any deviations from these Terms and Conditions shall only be valid if agreed upon in writing.
2.3. By placing an order through the Website, the Customer accepts these Terms and Conditions.
Article 3. Products and Product Information
3.1. Kootje Boef offers original graphic apparel, posters, robot sculptures, and related design products.
3.2. Product images are intended as representations of the design and product. Minor variations in colour, print placement, materials, wood grain, engraved details, plexiglass components, and other production-related characteristics may occur.
3.3. Such variations are inherent to the production process and shall not be considered defects.
3.4. Kootje Boef makes every effort to accurately display colours and product details. However, actual colours may vary depending on monitor, device, browser, and print characteristics.
Article 4. Prices
4.1. All prices displayed on the Website include VAT where applicable unless stated otherwise.
4.2. Shipping costs, where applicable, are displayed before checkout. Certain product categories may qualify for free shipping as indicated on the Website. Free shipping, where offered, does not include import duties, customs fees, taxes, or other charges imposed by local authorities.
4.3. Obvious pricing errors, typographical mistakes, technical errors, or system malfunctions do not create a binding agreement.
4.4. Kootje Boef reserves the right to cancel orders resulting from such errors and refund any amounts already paid.
Article 5. Formation of the Agreement
5.1. The Agreement is concluded when Kootje Boef confirms the Customer’s order.
5.2. Kootje Boef reserves the right to refuse or cancel orders in the event of suspected fraud, incorrect pricing, unavailable products, or incorrect customer information.
Article 6. Production and Delivery
6.1. Most products offered by Kootje Boef are produced only after an order has been placed.
Apparel and Posters
6.2. Apparel and posters are generally produced within 5 to 7 business days.
Robot Sculptures
6.3. Robot Sculptures and Christmas Robots are produced on demand and generally require up to 10 business days before shipment.
6.4. Production times are estimates and not guaranteed delivery dates.
6.5. Once shipped, delivery times depend on destination, shipping carrier, customs procedures, and circumstances beyond Kootje Boef’s control.
6.6. Kootje Boef is entitled to engage third-party production, fulfilment, and shipping partners.
6.7. Risk of loss or damage transfers to the Customer upon delivery at the specified delivery address.
Article 7. International Orders and Customs
7.1. Kootje Boef ships worldwide.
7.2. Customers outside the European Union may be responsible for import duties, customs charges, taxes, or local fees imposed by their country’s authorities.
7.3. Such charges are the sole responsibility of the Customer.
7.4. Kootje Boef has no control over customs procedures and cannot guarantee delivery times affected by customs inspections or delays.
Article 8. Right of Withdrawal and Returns
8.1. Most products sold by Kootje Boef are produced specifically after an order has been placed.
8.2. These products are therefore considered made-to-order or personalised products and are generally exempt from the statutory right of withdrawal as provided under applicable consumer legislation.
8.3. Orders cannot be cancelled once production has started.
8.4. Nothing in these Terms and Conditions limits any mandatory consumer rights that may apply under applicable law.
Apparel Sizing
8.4. Detailed size charts are provided on product pages.
8.5. Customers are strongly encouraged to carefully consult these measurements before placing an order.
8.6. As products are produced on demand, selecting the correct size remains the responsibility of the Customer.
8.7. If a Customer experiences a sizing issue, they are encouraged to contact Kootje Boef.
8.8. While returns, exchanges, or refunds for sizing issues cannot be guaranteed, Kootje Boef will review each situation individually and work with the Customer to find a reasonable solution where possible.
Damaged or Incorrect Products
8.9. If a product arrives damaged, defective, or differs materially from the order placed, the Customer must notify Kootje Boef within 14 days of delivery.
8.10. Where appropriate, Kootje Boef may offer replacement, repair, refund, or another reasonable solution.
Article 9. Robot Sculptures
9.1. Robot Sculptures are produced on demand and assembled by hand from laser-cut components, selected materials, and hardware.
9.2. Certain robot models may incorporate vintage construction toy parts or other reclaimed materials.
9.3. Due to the use of such materials, minor variations between individual robots are to be expected.
9.4. Product photographs represent the overall design and appearance of the model ordered but may not be identical to the delivered item.
9.5. These variations contribute to the character and uniqueness of each robot sculpture and do not constitute defects.
Article 10. Payment
10.1. Payments are processed through secure third-party payment providers, including Mollie.
10.2. Orders will only enter production after payment has been successfully received.
10.3. Kootje Boef reserves the right to suspend or cancel orders in cases of suspected fraud or payment irregularities.
Article 11. Warranty and Conformity
11.1. Kootje Boef guarantees that products conform to the Agreement and applicable legal requirements.
11.2. The Customer must inspect products upon delivery and report any defects without undue delay.
11.3. Normal wear and tear, misuse, improper handling, accidental damage, and modifications made by the Customer are excluded from warranty coverage.
11.4. Any liability shall be limited to repair, replacement, refund, or the purchase price paid for the product, at Kootje Boef’s discretion.
Article 12. Complaints
12.1. Complaints may be submitted via:

12.2. Kootje Boef will respond as quickly as reasonably possible and generally within 5 business days.
12.3. Both parties will make reasonable efforts to resolve complaints amicably.
Article 13. Intellectual Property
13.1. All intellectual property rights relating to the Website, products, artwork, illustrations, designs, graphics, photographs, product concepts, logos, branding, texts, robot designs, posters, and apparel graphics remain the property of Kootje Boef unless otherwise stated.
13.2. Purchasing a product does not transfer any intellectual property rights to the Customer.
13.3. No content may be copied, reproduced, distributed, modified, sold, licensed, or otherwise exploited without prior written permission.
13.4. Additional provisions regarding intellectual property can be found in the Copyright & Intellectual Property Policy published on the Website.
Article 14. Artistic Inspiration and Third-Party Rights
14.1. Certain products may be inspired by music, film, technology, art, culture, historical events, public figures, or other cultural references.
14.2. Such references are used solely as artistic inspiration and creative interpretation.
14.3. Unless explicitly stated otherwise, products sold by Kootje Boef are not official merchandise and are not affiliated with, endorsed by, sponsored by, licensed by, or otherwise connected to any artist, band, estate, trademark owner, company, organisation, or rights holder.
14.4. All third-party trademarks, copyrights, and intellectual property rights remain the property of their respective owners.
Article 15. Privacy
15.1. Personal data is processed in accordance with the Privacy Policy published on the Website.
Article 16. Liability
16.1. To the maximum extent permitted by law, Kootje Boef shall not be liable for indirect, incidental, special, or consequential damages.
16.2. Any liability shall in all cases be limited to the amount paid by the Customer for the product giving rise to the claim.
16.3. Nothing in these Terms shall exclude liability where exclusion is prohibited by applicable law.
Article 17. Applicable Law
17.1. These Terms and Conditions are governed exclusively by Dutch law.
17.2. Any disputes arising from these Terms and Conditions shall be submitted to the competent court in the Netherlands, unless mandatory law requires otherwise.
Article 18. Force Majeure
18.1. Kootje Boef shall not be liable for any delay, failure, or inability to perform its obligations where such delay or failure results from circumstances beyond its reasonable control.
18.2. Such circumstances include, but are not limited to, natural disasters, fire, flood, pandemic, epidemic, war, terrorism, labour disputes, strikes, transportation disruptions, governmental measures, supply chain interruptions, failures of suppliers, fulfilment partners, hosting providers, payment providers, shipping carriers, internet outages, or other unforeseen events.
18.3. During a force majeure situation, Kootje Boef may suspend its obligations for the duration of the event or terminate the Agreement without liability.
Article 19. Electronic Communication
19.1. By using the Website and placing an order, the Customer agrees to receive communications electronically.
19.2. Electronic communications, including emails and order confirmations, satisfy any legal requirement that such communications be made in writing.
Article 20. Severability
20.1. If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
20.2. Any invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
